Terms of Service

These Terms of Service ("Terms") govern your use of Breed Ledger, operated by Built By Dusty ("we," "our," or "us"), including the website at breedledger.co and all breeder subdomain sites (such as yourprogram.breedledger.co). By creating an account or using the platform you agree to these Terms. If you do not agree, do not use Breed Ledger.

1. Eligibility

You must be at least 18 years old to create an account. By registering, you represent that you are at least 18 and that all information you provide is accurate and complete. Breed Ledger is intended for use in the United States. We make no representation that the platform is appropriate or available in other locations.

2. Your Account

• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• You must notify us immediately at dmumphrey@builtbydusty.com if you become aware of any unauthorized use of your account.
• You may not share your account credentials with others or create accounts on behalf of another person without their authorization.
• Each account may operate one breeder program on the Starter and Professional plans. Enterprise and organization plans may have different limits.

3. Acceptable Use

You agree to use Breed Ledger only for lawful purposes and in accordance with these Terms. You must not:

• Post content that is false, misleading, defamatory, harassing, obscene, or that infringes any third-party intellectual property rights.
• Use the platform to advertise, sell, or facilitate the sale of animals in violation of any applicable law, including laws prohibiting animal cruelty or unlicensed commercial breeding.
• Attempt to gain unauthorized access to any part of the platform, other users' accounts, or Breed Ledger's infrastructure.
• Use automated tools (scrapers, bots, crawlers) to extract content or data from the platform without our written permission.
• Circumvent, disable, or otherwise interfere with security features of the platform.
• Misrepresent pedigrees, genetics, health records, or other animal data in a way that could deceive buyers or registries.
• Use the platform to send spam, unsolicited communications, or bulk messages to visitors or other users.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

4. Your Content

You retain ownership of all content you upload or create on Breed Ledger (animal records, photos, pedigrees, descriptions, and pages). By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit that content solely for the purpose of providing the platform to you and your site visitors. We do not claim ownership of your content and will not use it for any other purpose without your permission.

You represent that you have all necessary rights to the content you upload and that it does not violate any third-party rights or applicable laws. You are solely responsible for the accuracy and legality of your content.

5. Subscription Plans and Billing

Plans and pricing

Breed Ledger is offered on a subscription basis. Current plan details and pricing are available at breedledger.co/pricing. We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

Payment

Subscriptions are billed monthly or annually in advance. Payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All fees are in US dollars and are non-refundable except as described below.

Free trial and early-access offers

Early-access members who joined the waitlist before the platform launch on May 15, 2026, receive 6 months of free access as offered at the time of signup. After the free period, your account will convert to a paid subscription at the then-current plan rate unless you cancel before the trial ends.

Cancellation and refunds

You may cancel your subscription at any time from your Admin panel. Cancellation takes effect at the end of your current billing period; you will retain access until then. We do not provide prorated refunds for unused time on monthly plans. Annual plan refunds may be issued at our discretion within 30 days of renewal.

6. Platform Availability

We aim to keep Breed Ledger available 24/7 but do not guarantee uninterrupted access. We may perform maintenance, apply updates, or experience outages beyond our control. We will communicate planned downtime in advance when reasonably possible. We are not liable for any loss or damage caused by downtime.

7. Intellectual Property

The Breed Ledger name, logo, platform code, design system, and all original content created by us are our intellectual property and may not be copied, reproduced, or used without our written permission. Your content remains yours as described in Section 4.

8. Disclaimer of Warranties

BREED LEDGER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF BREED LEDGER, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Breed Ledger, its owners, officers, and contractors from any claim, liability, damage, or expense (including reasonable attorney's fees) arising from your use of the platform, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, failure to pay, or any other reason we determine at our sole discretion, with or without notice. You may close your account at any time through your Admin panel or by contacting us. Upon termination, your public site will be taken offline and your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page and, for material changes, send an email to registered account holders at least 14 days before the changes take effect. Continued use of Breed Ledger after the effective date constitutes your acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms or your use of Breed Ledger shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.
